Consumer Guarantees Act 1993
The Consumer Guarantees Act 1993 (CGA) is New Zealand’s core consumer-protection law that implies non-excludable conditions and warranties into most consumer transactions. It covers products and certain services, including guarantees around acceptable quality, fitness for purpose, and remedies when goods do not meet those guarantees.
AppleCare+ is an extended protection product, so the CGA can materially affect how Apple must handle customer claims—particularly where the device or its service fails (e.g., “acceptable quality” or “fit for purpose”). Even if AppleCare+ terms limit liability or set process requirements, Apple generally cannot contract out of the CGA’s consumer guarantees; customers may be able to rely on CGA remedies in addition to (or instead of, depending on circumstances) AppleCare+ coverage.
