Product Liability and Warranty Litigation in China
China’s PRC Consumer Protection Law includes provisions under which consumers (or other victims) may seek remedies for personal injuries or property damage caused by defective goods. The law frames liability in the context of defects, damages, and consumer rights, which can overlap with how warranties and product liability claims are handled for goods sold in China.
AppleCare+ is separate from statutory consumer remedies, but this kind of consumer protection/product liability regime can materially affect Apple’s overall risk and obligations in China. It may increase the likelihood that defective-device scenarios lead to claims beyond the scope of voluntary warranties (and potentially influence claim handling, disclosures, and how AppleCare+ coordinates with statutory rights). AppleCare+ may still mitigate costs for covered mechanical/electrical issues, but it likely can’t contract around statutory liability for defects causing injury or property damage.
